Terms and Conditions of OgarnijPrawko.pl

Effective from 26 August 2026.

§ 1. General provisions

1. These Terms and Conditions define the rules for using the OgarnijPrawko.pl website, in particular the rules for creating an Account, using tests preparing users for the Polish state theoretical driving licence examination, purchasing paid access, and using accounts intended for Driving Training Centres.

3. The Service Provider can be contacted by e-mail, through the contact form available on the Website, and by the telephone number indicated above.

4. These Terms and Conditions are made available free of charge in a form that enables them to be obtained, saved and reproduced at any time.

5. By starting to use the Website services, the User is obliged to comply with these Terms and Conditions.

6. OgarnijPrawko.pl is an independent educational website. The Website is not operated, co-operated or authorised by the Polish Ministry of Infrastructure, Voivodeship Road Traffic Centres (WORD) or any other public authority.

7. The Website is intended to support preparation for the examination. Use of the Website does not guarantee a positive result in the Polish state theoretical or practical driving licence examination.

§ 2. Definitions

For the purposes of these Terms and Conditions, the following terms have the meanings set out below:

  1. Website – the website available at OgarnijPrawko.pl together with the functionalities provided through it.
  2. Service Provider – Emabe Mateusz Mączka.
  3. User – a person using the Website.
  4. Individual User – a natural person using the Website to prepare for a driving licence examination.
  5. Consumer – a natural person entering into a legal transaction with the Service Provider which is not directly related to their business or professional activity.
  6. Driving Training Centre (OSK) – a driving training centre or another business entity using Website functionalities intended for entities training driving licence candidates.
  7. Account – an individual User account on the Website.
  8. OSK Account – an account intended for handling orders for access codes for trainees.
  9. Access Code – a unique code enabling activation of paid access for an Individual User. The code may be used once.
  10. Paid Access – a paid digital service enabling use of Website functionalities for a period of 3 months.
  11. Free Test – a limited, free version of the test available under the rules specified on the Website.
  12. Order – a declaration made by a User or OSK aimed at concluding an agreement for paid services.

§ 3. Type and scope of services

4. The User is obliged to use the Website in accordance with the law, these Terms and Conditions and generally accepted standards of conduct.

5. It is prohibited to take actions that interfere with the operation of the Website, circumvent its security measures, obtain unauthorised access to other users' accounts or use the Website to provide unlawful content.

§ 4. User Account

1. Creating an Account requires providing the data indicated in the registration form and accepting these Terms and Conditions.

2. The User is responsible for keeping confidential the data enabling access to the Account.

3. One Account is intended for use by the person for whom it was created.

4. The User may request deletion of the Account. Deletion of the Account does not result in deletion of data which the Service Provider is required to retain under applicable law, in particular accounting and settlement records or data necessary to establish, pursue or defend claims.

5. Deletion of the Account does not affect the User's rights arising from previously concluded agreements or their complaint rights.

§ 5. Paid access for Individual Users

1. The price of Paid Access for an Individual User is PLN 15.00 gross.

2. The stated price is the total price for the scope and period of access indicated in the offer immediately before the Order is placed.

3. Before placing an Order, the User receives information concerning, in particular:

4. The agreement is concluded after the Order has been successfully placed and the Service Provider has received payment confirmation, unless the description of the selected payment method provides otherwise.

5. The User receives confirmation of the conclusion of the agreement and information required by law on a durable medium at the e-mail address provided.

6. The Website does not charge the User any fees which were not disclosed before placing the Order.

7. The button completing the purchase process is labelled in a manner that clearly indicates that using it entails an obligation to pay.

§ 6. Commencement of service before expiry of the withdrawal period

1. A Consumer may request that the paid service begin before the expiry of the 14-day withdrawal period.

2. In such a case, before performance begins, the Website obtains from the Consumer a separate and express request to begin performance before the withdrawal period expires and confirmation that the Consumer acknowledges the rules concerning the right of withdrawal.

3. Mere acceptance of these Terms and Conditions is not treated as such a request.

4. If the Consumer withdraws from the agreement after performance has begun at their express request, the Consumer may be required to pay an amount proportionate to the scope of the service provided until the time of withdrawal, if the statutory conditions for such payment are met.

5. The right to withdraw from a paid service agreement may be lost after the service has been fully performed where performance began with the Consumer's prior express consent and the Consumer was informed in advance that full performance would result in the loss of the right of withdrawal and acknowledged this information.

§ 7. Right of withdrawal from the agreement

1. A Consumer who concludes a distance agreement generally has the right to withdraw from it within 14 days from the date of conclusion without giving any reason.

2. It is sufficient to send the withdrawal statement before the expiry of the deadline.

Following an effective withdrawal, the Service Provider refunds any amounts due to the Consumer without undue delay and no later than 14 days from receipt of the withdrawal statement, using the same payment method used by the Consumer unless the Consumer expressly agrees to another method that does not involve any costs for them.

§ 8. OSK Account and purchase of access codes

1. A Driving Training Centre may create an OSK Account intended for purchasing and managing access codes for its trainees.

2. The OSK Account does not provide access to the full paid version of the tests. From the OSK Account, only the Free Test and functionalities related to the purchase and management of codes are available.

3. A trainee obtains access to the full version of the Website after redeeming the received code on their Individual User Account.

4. An OSK may purchase any number of codes in a single Order.

5. The base price of one code is PLN 15.00 gross, including 23% VAT.

6. Discounts depend on the number of codes included in one Order:

7. The total Order price, discount amount and unit price are presented to the OSK before the Order is placed.

8. Once payment is confirmed, the appropriate set of codes is generated for the Order.

9. Codes are assigned to a specific Order.

10. Each code may be activated once. After it is used, the system records a status showing that the code has been redeemed.

§ 9. CSV and PDF files for OSK

1. After an Order has been completed, the OSK receives an e-mail containing a CSV file with the generated codes or a secure link enabling its download.

2. The OSK Account panel provides an Order history.

3. Each Order includes functions for downloading a PDF file and a CSV file.

4. The PDF file contains only the codes assigned to a specific Order.

5. Each code is presented on a separate page of the PDF file.

6. Each PDF page contains at least:

7. PDF files for OSK are generated in Polish only.

8. The CSV file available in the panel contains the codes belonging to the Order and information about the current status of each code, in particular whether it has already been used.

9. If the CSV file is downloaded again, the code usage status reflects the state of the system at the time the export is generated.

§ 10. Invoices for OSK

1. When placing an Order, the OSK may indicate that it wishes to receive an invoice.

2. In that case, the following invoice details must be provided:

4. The invoice is issued in accordance with the regulations applicable on the date of issue, including, where applicable, regulations concerning the Polish National e-Invoice System (KSeF).

5. The method of making the invoice available complies with the currently applicable tax regulations.

§ 11. Complaints

1. A User may submit complaints concerning the operation of the Website, payments, the Account, access codes and the conformity of the service with the agreement.

4. Failure to provide information that is not legally required does not automatically result in rejection of the complaint.

5. Consumer complaints are handled within 14 days from the date they are received.

6. The response to a Consumer complaint is provided on paper or another durable medium, in particular by e-mail.

If the digital service is not in conformity with the agreement, the Consumer is entitled to the remedies provided for by the Polish Consumer Rights Act, in particular the right to request that the service be brought into conformity with the agreement and, in the cases specified by law, to a price reduction or withdrawal from the agreement.

8. These Terms and Conditions do not limit any mandatory rights of Consumers.

§ 12. OSK Orders and consumer rights

1. The OSK Account and the purchase of codes are generally intended for use in connection with business or professional activity.

2. If, in a specific case, mandatory law grants a natural person conducting business activity certain consumer rights because the agreement is not of a professional nature for that person, these Terms and Conditions do not exclude such rights.

3. In other cases, the statutory 14-day right of withdrawal applicable to Consumers does not apply to an OSK making a purchase of a professional nature.

§ 13. Source of questions and rights to materials

1. The Website uses questions from the official driving licence examination question database published by the Polish Ministry of Infrastructure.

2. Under applicable law, approved examination questions and the scenarios, visualisations and descriptions forming part of them constitute public information.

3. OgarnijPrawko.pl does not claim exclusive copyright in official examination questions or in elements which, under applicable law, have the status of official materials.

4. The Website does not rely on this basis to use third-party materials which do not form part of an approved examination question where their use requires separate consent or a licence.

5. Original content created specifically for OgarnijPrawko.pl, in particular answer explanations, educational texts, the logo, graphic elements, the interface, original graphics, PDF templates and instructional materials, is protected in accordance with applicable law.

6. Use of the official question database by OgarnijPrawko.pl does not imply cooperation with or authorisation of the Website by the Polish Ministry of Infrastructure.

§ 14. Currency of questions

1. The Service Provider updates the question database used by the Website on the basis of subsequent official publications of the Polish Ministry of Infrastructure.

2. The Website displays information about the version of the official database currently in use.

3. The currently used database version is: 07/2026.

4. If the competent authorities amend, withdraw or publish new questions, the Website may update the database accordingly.

5. Answer explanations are educational materials prepared by OgarnijPrawko.pl and do not constitute official explanations of the Polish Ministry of Infrastructure or WORD.

§ 15. Liability and availability of the Website

1. The Service Provider exercises due care to ensure that the Website operates correctly and in accordance with the current scope of the services provided.

2. Short interruptions may occur, in particular due to maintenance, updates, security measures or infrastructure failures.

3. These Terms and Conditions do not exclude or limit the Service Provider's liability towards a Consumer to the extent that such exclusion or limitation is not permitted by law.

4. The Website is educational in nature. Results obtained on the Website are not results of a state examination and do not grant any right to drive a vehicle.

§ 16. Out-of-court dispute resolution

1. A Consumer may use out-of-court complaint handling and claim resolution procedures in accordance with applicable law.

2. A Consumer may obtain assistance, among others, from the competent municipal or district consumer ombudsman and may use information published by the Polish Office of Competition and Consumer Protection (UOKiK).

3. Participation in an out-of-court dispute resolution procedure is voluntary unless mandatory law provides otherwise.

§ 17. Amendments to the Terms and Conditions

1. These Terms and Conditions may be amended, in particular, in the event of changes in law, the scope of services, Website functionalities, payment methods, technical requirements or the need to ensure Website security.

2. Amendments do not affect rights already acquired by Users.

3. If an amendment concerns an ongoing digital service agreement and may significantly affect the Consumer, the Service Provider applies the information requirements and Consumer rights resulting from applicable law.

4. The current version of these Terms and Conditions is always available on the Website.

§ 18. Final provisions

1. Agreements concluded through the Website are governed by Polish law, subject to mandatory provisions protecting Consumers.

2. In matters not regulated by these Terms and Conditions, applicable law applies, in particular the Polish Civil Code, the Polish Consumer Rights Act, the Polish Act on the Provision of Electronic Services and applicable personal data protection regulations.
